Als rechtlich verbindliche Orientierung zur H\u00f6he der Unterhaltsanspr\u00fcche gilt die D\u00fcsseldorfer Tabelle, die etwa alle zwei Jahre vom Deutschen Familiengerichtstag und dem D\u00fcsseldorfer Oberlandesgericht aktualisiert wird. Unterhaltspflichtig ist laut Gesetz das Elternteil, bei dem sich gemeinsame, minderj\u00e4hrige Kinder nicht st\u00e4ndig aufhalten (nachzulesen im Paragraph 1612a BGB).<\/span><\/p>\n<hr \/>\n<div>\n<div>\n<article class=\"article-free-text default clearfix\" data-history-node-id=\"6351\">\n<div class=\"content\">\n<div>\n<h2 id=\"Die H\u00f6he der Unterhaltsanspr\u00fcche\"><span class=\"ez-toc-section\" id=\"die-hoehe-der-unterhaltsansprueche\"><\/span>Die H\u00f6he der Unterhaltsanspr\u00fcche<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Der Mindestunterhalt orientiert sich am aktuellen Kinderfreibetrag gem\u00e4\u00df dem Einkommenssteuergesetz. Einem Kind, dessen Eltern getrennt leben, stehen demnach seit Januar 2019\u00a04.872 Euro pro Jahr zu. Das entspricht dem doppelten Kinderfreibetrag und f\u00fchrt zu einem monatlichen Mindestanspruch von 406 Euro. Dieser Betrag wird gem\u00e4\u00df dem Alter des Kindes aufgestockt oder vermindert. So erh\u00e4lt ein Kind beispielsweise in den ersten sechs Lebensjahren einen Mindestunterhalt von 354\u00a0Euro. Ab dem 18. Lebensjahr bis zur Beendigung der Berufsausbildung liegt dieser bei 527\u00a0Euro. Je nach H\u00f6he des Verdienstes, den der Unterhaltspflichtige erh\u00e4lt, steigt der Anspruch und ist in der D\u00fcsseldorfer Tabelle entsprechend festgelegt.<\/p>\n<p class=\"rtecenter text-align-center\"><img decoding=\"async\" src=\"https:\/\/www.windeln.de\/magazin\/wp-content\/uploads\/2023\/09\/duesseldorfer_tabelle_2019.png\" alt=\"Duesseldorfer Tabelle\" data-entity-type=\"\" data-entity-uuid=\"\" \/><br \/>\n<a href=\"http:\/\/www.olg-duesseldorf.nrw.de\/infos\/Duesseldorfer_Tabelle\/index.php\">ABBILDUNG: D\u00dcSSELDORFER TABELLE 2019<\/a><\/p>\n<h2 id=\"Nicht in der D\u00fcsseldorfer Tabelle sind aufgef\u00fchrt:\"><span class=\"ez-toc-section\" id=\"nicht-in-der-duesseldorfer-tabelle-sind-aufgefuehrt\"><\/span>Nicht in der D\u00fcsseldorfer Tabelle sind aufgef\u00fchrt:<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li>Beitragszahlungen f\u00fcr die Kranken- und Pflegeversicherung des leiblichen Kindes,<\/li>\n<li>Schul- und Studiengeb\u00fchren<\/li>\n<li>andere Mehrbedarfsleistungen<\/li>\n<\/ul>\n<p>Auch Sonderbedarfe, wie hohe, einmalige, notwendige Ausgaben, wie sie beispielsweise in medizinischen Zusammenh\u00e4ngen auftreten k\u00f6nnen, m\u00fcssen zus\u00e4tzlich vom unterhaltspflichtigen Elternteil mitgetragen werden.<\/p>\n<h2 id=\"Kindergeld und Unterhalt\"><span class=\"ez-toc-section\" id=\"kindergeld-und-unterhalt\"><\/span>Kindergeld und Unterhalt<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Obwohl das Kindergeld den Eltern zu gleichen Anteilen zusteht, wird es nach einer Trennung an das Elternteil ausgezahlt, in dessen Haushalt sich das gemeinsame Kind \u00fcberwiegend aufh\u00e4lt. Die zustehenden 50 Prozent werden allerdings mit dem bestehenden Unterhaltsanspruch verrechnet, sodass bei den ersten beiden Kindern 102\u00a0Euro, beim dritten Kind 105\u00a0Euro und ab dem vierten 117,50 Euro dem zu leistenden Unterhaltsbetrag gutgeschrieben werden und sich somit die Auszahlung f\u00fcr Unterhaltspflichtige entsprechend reduziert.<\/p>\n<h2 id=\"Unterhaltsberechnung bei mehreren Kindern\"><span class=\"ez-toc-section\" id=\"unterhaltsberechnung-bei-mehreren-kindern\"><\/span>Unterhaltsberechnung bei mehreren Kindern<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Sind mehrere Kinder von der Unterhaltsregelung betroffen, reicht oftmals das Gehalt von Unterhaltspflichtigen nicht aus, um allen finanziellen Verpflichtungen nachzukommen. F\u00fcr diesen Fall hat der Gesetzgeber eine Rangfolge festgelegt, die bestimmt, welches Kind zuerst unterhaltsberechtigt ist.
